When you download our free guide, you can optionally subscribe to marketing communications by checking the marketing consent checkbox.

Key points:

  • You can unsubscribe from marketing emails at any time by clicking the unsubscribe link in any marketing email
  • Unsubscribing from marketing will not affect essential service communications

Trackable Life provides personalized coaching services to help you manage life events, appointments, and deadlines. We value your privacy and are committed to protecting your personal information.

Brand Ownership: Trackable Life is a brand owned and operated by Hofland Solutions, LLC, a Massachusetts limited liability company.

2. Information We Collect

Account Information:

  • Name and email address (protected by database encryption)
  • Timezone and appearance preferences
  • Billing email address (if different from primary email)

Coaching Session Information:

  • Life events you want to track (car maintenance, appointments, document renewals, etc.)
  • Calendar entries and reminders you create with your coach
  • Session notes and progress tracking
  • Communication between you and your coach

Sensitive Health Information (Additional Encryption Applied):

  • Self-reported conditions (e.g., ADHD, anxiety, other health concerns) - encrypted
  • Medication names and medication-related reminders - encrypted
  • Health-related appointments and notes you choose to share with your coach - encrypted

Authentication & Security:

  • Password hash (your actual password is never stored) - securely hashed with Argon2
  • Login activity and security logs
  • Session tokens (cryptographically signed, not stored in database)

Usage Information:

  • IP address, browser type, and device information
  • Pages visited and features used (for service improvement)
  • Error logs and diagnostic information
3. How We Protect Your Data

Multiple Layers of Security:

We implement comprehensive security measures to protect your information at every level:

Infrastructure Security:

  • Isolated Network: Application runs on DigitalOcean Virtual Private Cloud (VPC), isolated from public internet except through secure, controlled entry points
  • Database Security: Managed database with encryption at rest, automatic security updates, and regular backups
  • HTTPS Enforcement: All connections forced to HTTPS/TLS encryption at infrastructure level for data in transit
  • Regular Security Updates: Automated security patching and continuous monitoring

Application-Level Encryption:

  • Sensitive self-reported data (health conditions, medications, personal notes) is encrypted within the database using AES-256 encryption
  • Passwords are hashed using Argon2, a memory-hard algorithm that resists cracking attempts
  • Cryptographically signed tokens for email verification and password reset links
  • Encryption keys stored separately from encrypted data in secure configuration management

Searchable Information:

  • Searchable data, like name, email, appointment dates, and other service-related information, are protected by database-level encryption at rest and HTTPS in transit, but remain searchable so you and your coach can effectively use the service
  • All data access is strictly limited to authorized personnel only

What This Means for You:

Your most sensitive information—such as health conditions, medications, and personal notes you share with your coach—receives an additional layer of encryption beyond our standard database security. Even if someone gained unauthorized access to our database, this encrypted data would be unreadable without the encryption keys, which are stored separately and securely. Searchable data remains protected by database-level encryption and secure transmission protocols.

4. Authentication Security

Password-Based Login with Mandatory Two-Factor Authentication:

  • Password Authentication: Your password is securely hashed using Argon2, a modern, memory-hard algorithm designed to resist cracking attempts.
  • Email Verification: Every login requires email verification as a second authentication factor, ensuring only you can access your account even if your password is compromised.
  • No Plain-Text Password Storage: We never store your actual password—only a cryptographic hash that cannot be reversed.
5. How We Use Your Information

We use the information we collect solely to provide and improve our coaching services:

  • Provide personalized coaching and calendar management support
  • Track life events, appointments, and deadlines you want to manage
  • Send appointment reminders, session confirmations, and service notifications
  • Communicate with you about your coaching sessions and account
  • Improve our service based on usage patterns (anonymized where possible)
  • Respond to your questions and provide customer support
  • Comply with legal obligations and protect our rights

We will never:

  • Sell your personal information to third parties
  • Share your sensitive health information without your consent (except as legally required)
  • Use your information for purposes other than providing coaching services
5a. Marketing Communications (Separate from Service Emails)

Marketing vs. Service Emails:

We distinguish between two types of email communications:

Service Emails (Always Sent, No Opt-Out):

  • Login tokens and authentication codes
  • Appointment confirmations and reminders
  • Security alerts and account notifications
  • Service updates affecting your account
  • Responses to your support requests

These emails are essential to providing our service and cannot be disabled.

Marketing Emails (Optional, Requires Consent):

  • Product updates and new features
  • Educational content about ADHD management and life organization
  • Tips for tracking life events effectively
  • Coaching best practices and success stories
  • Promotional offers and special events

Marketing emails are completely optional. We will ONLY send marketing emails if you explicitly opt in by checking the marketing consent checkbox when downloading guides or other lead magnets.

Your Marketing Consent Choices:

  • Opt-In: Check the marketing consent checkbox when downloading guides to receive marketing emails
  • Opt-Out: Don't check the box, or click "Unsubscribe" in any marketing email
  • Re-Subscribe: Download another guide and check the marketing consent checkbox
  • Service Emails Continue: Unsubscribing from marketing does NOT affect service emails (login tokens, appointment reminders, etc.)

Marketing Consent is:

  • Optional: Not required to use our service or download guides
  • Separate: Independent from Terms of Service and Privacy Policy acceptance
  • Unbundled: Not combined with any other consent
  • Revocable: Unsubscribe anytime by clicking the unsubscribe link in marketing emails
  • Tracked: We maintain an audit trail of when you opt in and opt out for compliance

6. Information Sharing and Third-Party Processors

We do not sell, trade, or rent your personal information. We share information only with trusted service providers who help us deliver our services:

  • DigitalOcean: Infrastructure hosting, database management, and data storage
  • Zoho ZeptoMail: Transactional email delivery (login tokens, appointment reminders, service notifications)
  • Cloudflare: DNS management, DDoS protection, and secure connectivity
  • Stripe: Payment processing (when applicable) - credit card data never touches our servers
  • Google Workspace: Video conferencing (Google Meet), scheduling (Google Calendar), and business communications (Gmail)
  • Google Analytics: Website analytics to understand usage patterns and improve our service (anonymized data)

All processors have signed data processing agreements and are contractually obligated to protect your information. For detailed information about our processors, see our Processors page.

Legal Disclosures:

We may disclose your information if required by law or in response to:

  • Valid legal process (court orders, subpoenas, warrants)
  • Protecting our rights, property, or safety, or that of others
  • Investigating fraud, security issues, or violations of our Terms of Service
  • Compliance with applicable laws and regulations
7. Confidentiality of Coaching Relationship

Commitment to Confidentiality:

Your coach commits to keeping all information shared during coaching sessions strictly confidential. However, the coaching relationship is not a legally privileged relationship like that with a doctor, lawyer, or licensed therapist.

Exceptions to Confidentiality:

Your coach may be required to disclose information in the following situations:

  • Imminent Harm: If the coach believes you pose an imminent threat of serious harm to yourself or another person
  • Abuse/Neglect: If the coach suspects abuse or neglect of a child, elderly person, or disabled person (mandatory reporting laws)
  • Court Order: If required by law or court order
8. Data Retention

Active Accounts:

  • We retain your personal information and coaching session data as long as your account is active
  • You can request deletion of specific information at any time

Coaching Session Data:

  • During Active Coaching: Session notes, trackables, and coaching communications are retained indefinitely while your coaching relationship continues
  • After Coaching Ends: We retain your coaching data for 90 days, then automatically and permanently delete it
  • What's Included: Session notes, trackables, coaching communications, and all related coaching data
  • Payment Records: Retained for 7 years after final payment (required by IRS for business tax records)

Why We Keep Data for 90 Days:

  • Gives you time to export your data if needed
  • Provides continuity if you decide to return to coaching within 90 days
  • Allows a grace period to change your mind

Your Control Over Data Deletion:

  • Immediate Deletion: You can request immediate deletion at any time (see Section 15 for contact information)
  • Timeline: Immediate deletion requests are usually completed within 7 days
  • No Waiting Required: Don't want to wait 90 days? Just ask and we'll delete immediately

Data Export:

  • Export your trackables and coaching data anytime through your account dashboard
  • We recommend exporting your data before ending your coaching relationship
  • Data provided in machine-readable format for portability

Session Recordings:

  • We do NOT record coaching sessions
  • No video or audio recordings are made, stored, or retained
  • This policy may be revisited in the future if recording features are added

Account Termination:

  • Upon account closure, all coaching data is automatically deleted after 90 days
  • You can request immediate deletion (usually completed within 7 days) - see Section 15 for contact information
  • Payment records retained for 7 years (IRS tax requirement for business financial records)
  • Anonymized usage data may be retained for service improvement

Backup Retention:

  • Deleted data may persist in encrypted backups for up to 30 days after deletion
  • Backups are encrypted and automatically purged on a rolling schedule
9. Your Rights

You have the following rights regarding your personal information:

Right to Access:

  • Request a copy of all personal information we hold about you
  • Receive your data in a readable, portable format
  • Response within 30 days of written request

Right to Correction:

  • Request correction of inaccurate or incomplete information
  • Update your account information directly through account settings

Right to Deletion:

  • Request deletion of your personal information
  • Delete your account at any time through account settings
  • Note: Some information may be retained for legal compliance (see Data Retention above)

Right to Data Portability:

  • Request export of your data in a machine-readable format
  • Transfer your data to another service

European Union Residents - GDPR Rights:

If you are a resident of the European Union, European Economic Area, or United Kingdom, you have rights under the General Data Protection Regulation (GDPR):

  • Right to Access: Request a copy of all personal information we hold about you

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA):

  • Right to Opt-Out: Say no to the sale of your personal information (Note: We do not sell personal information)
  • Right to Non-Discrimination: We will not discriminate against you for exercising your CCPA rights (same service and price regardless)

  • Right to Correct: Request correction of inaccurate personal information
  • Right to Delete: Request deletion of personal information (subject to legal retention requirements)

We Do Not Sell Your Personal Information:

Trackable Life does not sell personal information to third parties. We only share data with service providers who help us deliver coaching services (see our Processors page).

10. Security Incident Response

Breach Notification Protocol:

In the event of a confirmed security incident involving unauthorized access to your personal information:

  • Immediate Action: We will immediately take steps to secure the system and stop the breach
  • Assessment: We will assess the nature and scope of the unauthorized access
  • Client Notification: We will notify affected clients without unreasonable delay, describing:
    • What happened and when it was discovered
    • What information was involved
    • Steps we are taking to mitigate harm
    • Steps you can take to protect yourself
    • How to contact us for more information
  • Regulatory Notification: We will notify appropriate authorities as required by law
  • Remediation: We will implement additional safeguards to prevent future incidents

Our services are currently provided to clients in the United States. Your data is stored on servers located in the United States. By using our service, you consent to the transfer and processing of your information in the United States.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors.

How We Notify You:

  • We will post the updated policy on this page with a new effective date
  • For material changes affecting your rights, we will notify you via email
  • You may be required to review and accept updated policies before continuing to use the service
  • Continued use of our service after changes take effect constitutes acceptance of the updated policy

By accessing and using Trackable Life, you accept and agree to be bound by these Terms of Service and Coaching Agreement. Please read these terms carefully before using our service.

Brand Ownership: Trackable Life is a brand owned and operated by Hofland Solutions, LLC, a Massachusetts limited liability company.

1. Definitions
  • Service: Trackable Life, a web-based coaching platform for managing life events, appointments, and deadlines
  • Coach: The coaching professional assigned to work with you
  • Client: You, the user of the Service
  • Trackables: Life events that need to be followed, monitored, or managed over time (appointments, document renewals, maintenance schedules, etc.)
  • Session: A scheduled coaching appointment between Coach and Client
  • Package: A pre-purchased bundle of coaching sessions
  • Subscription: A recurring payment plan providing unlimited platform access while active
2. Service Description

What Trackable Life Provides:

Trackable Life is a personalized coaching service that helps you manage life events through:

  • One-on-one coaching sessions to identify and track important life events
  • Calendar management support and reminder systems
  • Accountability partnerships to help ensure tasks are completed
  • Recommendations for organizing and prioritizing trackable events
  • Session-by-session review of completed, missed, and upcoming events
3. What Coaching IS

Coaching through Trackable Life includes:

  • Accountability Partnership: Your coach works with you to track life events and provides regular check-ins
  • Calendar Management Support: Assistance with scheduling, organizing, and setting up reminders for important events
  • Organizational Recommendations: Suggestions for systems, tools, and strategies to manage your calendar and life events
  • Progress Tracking: Review of what was completed, what was missed, and what needs rescheduling
  • Resource Recommendations: Suggestions for apps, services, or professionals that may help with specific needs
4. CRITICAL: What Coaching IS NOT

Coaches are NOT licensed or qualified as (including but not limited to):

  • Medical professionals, physicians, or healthcare providers
  • Psychiatrists or psychologists
  • Licensed therapists, counselors, or mental health professionals
  • Licensed Professional Counselors (LPC) or Licensed Clinical Social Workers (LCSW)
  • Marriage and Family Therapists (MFT)
  • Financial advisors, certified financial planners (CFP), or investment advisors
  • Accountants, Certified Public Accountants (CPA), or tax professionals
  • Attorneys, lawyers, or legal advisors
  • Registered dietitians, nutritionists, or dietary counselors
  • Educational consultants or academic advisors
  • Career counselors or vocational rehabilitation specialists

COACHING IS NOT A SUBSTITUTE FOR (including but not limited to):

  • Professional medical care, diagnosis, or treatment
  • Mental health therapy or psychiatric services
  • Financial planning, investment advice, or tax preparation
  • Legal advice or representation
  • Any other licensed professional service

5. Scope of Coaching Services

Professional Standards:

Our coaching services align with the International Coach Federation (ICF) Code of Ethics, including commitments to confidentiality, professional conduct, and operating within appropriate boundaries. However, our coaches are not ICF-certified, and coaching is not a regulated profession.

Recommendations Only:

Your coach provides recommendations and suggestions only for tracking and managing life events. All recommendations are:

  • General suggestions, not professional advice
  • Based on organizational best practices, not medical, financial, or legal expertise
  • Subject to your independent research, evaluation, and decision-making
  • Provided without warranties or guarantees of any kind

Non-Clinical Suggestions for Professional Help:

Your coach may suggest seeking professional services (therapy, financial planning, medical care, etc.) in a non-diagnostic, non-clinical manner. For example:

  • "Have you considered exploring therapy options?" (not diagnosing or prescribing treatment)
  • "Would it be helpful to talk to a financial advisor about budgeting?" (not providing financial advice)
  • "It might be worth scheduling a checkup with your doctor." (not providing medical advice)

When your coach makes such suggestions, they may help you:

  • Schedule calendar time to research professionals in your area
  • Create reminders to call offices or make appointments
  • Set up trackable events for follow-up appointments

You remain solely responsible for:

  • Researching and selecting qualified professionals
  • Determining whether professional services are appropriate for your needs
  • Evaluating credentials, qualifications, and fit
  • Making final decisions about which professionals (if any) to work with
6. Client Responsibility & Comprehensive Liability Waiver

FUNDAMENTAL UNDERSTANDING:

Trackable Life provides organizational recommendations and calendar management support only. Clients are solely responsible for their own life decisions, health, finances, legal matters, and overall well-being. Coaches facilitate awareness and organization but bear no responsibility for outcomes, missed events, or consequences resulting from recommendations or lack thereof.

6.1 Client's Ultimate Responsibility

Client acknowledges and agrees that Client is solely and ultimately responsible for:

  • All Life Events: All appointments, deadlines, document renewals, maintenance schedules, and other trackable events—whether identified by Coach or not
  • Independent Research: Researching and vetting any recommended vendors, apps, systems, tools, or professionals before use
  • Final Decisions: Making all final decisions about which recommendations (if any) to implement
  • Personal Well-Being: Your own health, safety, mental health, financial decisions, legal matters, and overall well-being
  • Professional Services: Seeking appropriate professional help (medical, mental health, financial, legal, etc.) when needed
  • Calendar Management: Managing your own calendar, even with coaching support
6.2 No Liability for Missed Events

Client acknowledges and agrees that Coach cannot be held liable for any missed trackable events, including but not limited to:

  • Events the Coach recommended tracking
  • Events the Coach did NOT recommend tracking
  • Events that were scheduled but missed
  • Events that were not scheduled
  • Events that Client forgot despite reminders
  • Technical failures (app crashes, notification failures, calendar sync issues, etc.)

Consequences of Missed Events - No Coach Liability:

Coach cannot be held liable for any consequences resulting from missed events, including but not limited to:

  • Financial penalties, late fees, or expedited service charges
  • No-show fees for medical appointments or other services
  • Expired documents (passports, licenses, registrations, certifications)
  • Lapsed insurance or warranty coverage
  • Missed opportunities (flight deals, event tickets, registration deadlines)
  • Health consequences from missed medical appointments or medications
  • Vehicle impoundment, tickets, or violations from missed inspections/renewals
  • Relationship strain from forgotten birthdays, anniversaries, or events
  • Property damage from neglected maintenance
  • Legal consequences from missed court dates, filing deadlines, or legal obligations
  • Any other harm, damage, loss, or negative outcome of any kind
6.3 No Liability for Recommendations

Client acknowledges and agrees that Coach cannot be held liable for any recommendations made or not made, including but not limited to:

Recommendations Made:

  • Vendors, service providers, or contractors (plumbers, organizers, planners, etc.)
  • Apps, software, or technology tools (calendar apps, budgeting tools, organization systems)
  • Professionals (therapists, financial advisors, doctors, accountants, lawyers)
  • Strategies, systems, or organizational methods
  • Products, services, or resources of any kind

Recommendations NOT Made:

  • Coach cannot be held liable for failing to recommend a particular service, vendor, or strategy
  • Coach is not responsible for identifying all possible trackable events
  • Coach has no duty to recommend specific professionals, products, or services

Client's Duty to Research:

For ANY recommendation made by Coach, Client agrees to:

  • Conduct independent research and due diligence
  • Verify credentials, qualifications, licenses, and reputation
  • Read reviews, check references, and assess suitability
  • Make final decision based on Client's own evaluation
  • Accept full responsibility for the choice to use or not use any recommendation
6.4 No Liability for Third-Party Services

Client acknowledges and agrees that Coach cannot be held liable for any third-party vendors, apps, systems, or professionals that Client chooses to use, whether recommended by Coach or not.

Coach has no affiliation, control, or responsibility for:

  • Quality, safety, or suitability of third-party services
  • Data breaches, privacy violations, or security failures of third-party apps or services

  • Malpractice, negligence, or misconduct by recommended professionals
  • Terms of service, privacy policies, or business practices of third parties

Examples of No Liability:

  • If Coach recommends a budgeting app and that app suffers a data breach, Coach is not liable
  • If Coach suggests researching therapists and Client chooses an unsuitable therapist, Coach is not liable
  • If Coach recommends a home organizer and that organizer damages property, Coach is not liable
  • If Coach suggests a calendar app and Client loses data due to app failure, Coach is not liable
6.5 No Guaranteed Outcomes

Client acknowledges and agrees that Coach makes no guarantees, warranties, or promises regarding outcomes, including but not limited to:

  • Organizational Improvement: No guarantee of improved organization, productivity, or time management
  • Mental Health: No guarantee of reduced anxiety, stress relief, or improved mental well-being
  • Financial Savings: No guarantee of cost savings from avoiding late fees, penalties, or missed opportunities
  • Event Completion: No guarantee that trackable events will be completed on time or at all
  • Relationship Improvement: No guarantee of better relationships from remembering important dates
  • Health Outcomes: No guarantee of improved health from keeping medical appointments
  • Life Improvement: No guarantee of any specific improvement in quality of life

Results Vary:

Every client is different. Past client testimonials or case studies do not guarantee similar results for you. Your success depends on your own effort, follow-through, circumstances, and factors outside Coach's control.

6.6 Professional Services - Client Responsibility

When Coach suggests seeking professional help (therapy, medical care, financial planning, legal advice, etc.):

  • This is a non-clinical, non-diagnostic suggestion only
  • Coach is not qualified to diagnose conditions or prescribe treatments
  • Client must independently research, evaluate, and select professionals
  • Coach may assist with scheduling time to research or creating calendar reminders to make appointments
  • Client selects providers and makes all decisions about professional services
  • Coach is not responsible for the quality, suitability, or outcomes of professional services Client chooses
7. Account Requirements & Security

Account Creation:

  • You must provide accurate, current, and complete information during registration
  • You must be at least 18 years of age to use this service
  • You are responsible for maintaining the accuracy of your account information

Password and Two-Factor Authentication:

  • You must create a secure password meeting our complexity requirements (minimum 12 characters, including uppercase, lowercase, numbers, and special characters)
  • Every login requires email verification as a second authentication factor
  • You are responsible for keeping your password confidential and your email account secure
  • If you lose access to your email account, you may lose access to your Trackable Life account

Account Security:

  • You are responsible for all activity that occurs under your account
  • You must immediately notify us of any unauthorized access or security breach
  • Do not share your account credentials with anyone
  • We are not liable for losses resulting from unauthorized use of your account
8. Acceptable Use

You agree to use the Service only for lawful purposes and in a way that does not infringe the rights of others. You agree NOT to:

  • Violate any local, state, national, or international law
  • Harass, abuse, threaten, or intimidate coaches or other users
  • Share false, misleading, or fraudulent information
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Use automated systems (bots, scrapers) to access the Service
  • Interfere with or disrupt the Service or servers
  • Upload viruses, malware, or malicious code
  • Use the Service for any illegal or unauthorized purpose
9. Coaching Sessions

Scheduling & Attendance:

  • Sessions are scheduled by mutual agreement between Client and Coach
  • Session frequency may be weekly, bi-weekly, monthly, or as agreed
  • Sessions typically last 50 minutes unless otherwise specified
  • Client is responsible for attending scheduled sessions

Cancellations & Rescheduling:

  • Cancellation or rescheduling requests must be made at least 48 hours before your scheduled session
  • Cancellations with proper notice: Session credit retained for future use
  • Late cancellations or no-shows: Fees will apply per your Coaching Agreement
  • Repeated no-shows or late cancellations may result in service termination
  • Emergency exceptions may apply (medical emergencies, family emergencies)
  • Plan-specific terms: Your Coaching Agreement includes specific cancellation fees and policies for your plan

How to Cancel or Reschedule:

  • Email your coach directly

Session Conduct:

  • Sessions are conducted via video call, phone, or other agreed method
  • Client agrees to participate in good faith and communicate openly with Coach
  • Coach reserves the right to terminate sessions if Client is abusive, threatening, or disruptive
10. Payment, Fees & Refund Policy

Pricing:

  • Session fees are specified at time of booking or in your coaching agreement
  • Payment is due per the terms of your specific agreement
  • We reserve the right to modify pricing with 30 days' notice

Refund Policy:

Session Cancellations
  • 48+ hours notice: Session credit retained for future use
  • Less than 48 hours notice: Session is forfeited (no credit, no refund)
  • No-shows: Session is forfeited (no credit, no refund)
  • Emergency exceptions: Medical or family emergencies may be considered on a case-by-case basis
Coaching Packages (One-Time Purchases)
  • No refunds: Purchased packages are non-refundable
  • Sessions do not expire: Unused sessions remain available indefinitely until used
  • Non-transferable: Sessions cannot be transferred to another person
Subscriptions (Monthly Recurring)
  • Monthly renewal: Your subscription renews automatically each month at the price you initially signed up for
  • Price changes: We may adjust subscription pricing, but you will be notified at least 30 days before any price change takes effect for your account
  • Cancel anytime: You may cancel your subscription at any time through your account settings
  • Access after cancellation: Your subscription remains active until the end of your current billing period and will not renew
  • No refunds: No refunds or credits are provided for partial months or unused time; simply cancel before your next renewal date
General Refund Terms
  • Completed sessions: Non-refundable under any circumstances
  • Outcome dissatisfaction: No refunds are provided based on dissatisfaction with coaching outcomes (see "No Guaranteed Outcomes" in Section 6.5)

  • You agree to provide accurate payment information
  • You authorize us to charge your payment method for agreed fees
11. Coaching Packages & Platform Access

Coaching Packages:

When you purchase a coaching package (a bundle of sessions), the following terms apply:

  • Session Purchase: You are purchasing coaching sessions, not immediate platform access
  • Sessions Do Not Expire: Purchased sessions remain available until used; there is no expiration date
  • Multiple Packages: Sessions are deducted from the oldest package first (FIFO - First In, First Out)

Platform Access Model:

Additive Access: Each coaching session you use grants 30 days of platform access, added to your existing access.

  • No Immediate Access: Purchasing a package does not grant platform access until you use your first session
  • Access Begins: Platform access begins when you complete your first coaching session
  • Access Stacks: Each session used adds 30 days to your access expiration
  • Example: A 5-session package = 150 days of platform access (30 days per session used)

Example Scenario:

  • January 1: Purchase 5-session package (no platform access yet)
  • January 7: Complete Session 1 (access until February 6)
  • January 14: Complete Session 2 (access until March 8)
  • January 21: Complete Session 3 (access until April 7)
  • Total: 5 sessions = 150 days of cumulative platform access

Subscriptions:

  • Unlimited Access: Active subscriptions provide unlimited platform access while the subscription is active
  • Automatic Pause: Subscriptions are automatically paused when you purchase a coaching package (to prevent double-payment)
  • Resume: You can resume your subscription at any time after your package sessions are completed
  • Cancellation: Subscriptions can be cancelled at any time; access continues until the end of the billing period

Access Expiration:

  • When your platform access expires, you will no longer have access to trackables, dashboard, or other platform features
  • To regain access, you can: (1) use remaining sessions from a package, (2) purchase a new package, or (3) resume/start a subscription
  • Your data is retained per our Privacy Policy, even when access is expired
12. Intellectual Property

Our Property:

  • All content, features, and functionality of the Service (text, graphics, logos, software, etc.) are owned by Trackable Life or its licensors
  • You may not copy, modify, distribute, or create derivative works without permission
  • Trackable Life, our logo, and related marks are our property

Your Content:

  • You retain ownership of information you provide to us
  • You grant us a license to use your information solely to provide coaching services
  • We will not use your personal information for purposes outside of providing services without your consent

Custom Trackables (User-Created Templates):

  • If you create a custom trackable in the Service (a name, a category, a sequence of steps, and any properties you define), you grant Trackable Life a perpetual, worldwide, royalty-free license to use the structure of that trackable — name, category, step list, and property definitions — as a template that other clients of the Service may use.
  • This license covers structure only. It does not cover any of your personal data: your name, your item names, your notes, your dates, your vendor relationships, or any other information you enter while using the trackable. None of that is shared with other clients.
  • Before promoting a custom trackable to the shared catalog, Trackable Life may rename or restructure it for clarity. You will not be credited by name, and you have no obligation to maintain or update a promoted trackable.
  • You may continue to use, edit, or delete your personal copy of any custom trackable regardless of whether its structure has been promoted to the shared catalog.
13. Limitation of Liability

Maximum Liability:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRACKABLE COACH'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THIS AGREEMENT OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE VALUE OF THREE (3) COACHING SESSIONS, CALCULATED AT THE PER-SESSION RATE OF YOUR PLAN, REGARDLESS OF WHETHER SESSIONS WERE PURCHASED INDIVIDUALLY OR AS PART OF A PACKAGE.

No Liability for Indirect Damages:

IN NO EVENT SHALL TRACKABLE COACH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, revenue, or business
  • Loss of data or information
  • Missed opportunities or deadlines
  • Emotional distress or mental anguish
  • Medical expenses or health consequences
  • Property damage or personal injury
  • Any other indirect or consequential damages

This limitation applies even if we have been advised of the possibility of such damages.

No Warranty:

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

14. Indemnification

You agree to indemnify, defend, and hold harmless Trackable Life, its coaches, employees, contractors, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your decisions based on coaching recommendations
  • Your use of third-party services, vendors, or professionals (recommended or not)
  • Missed trackable events or consequences thereof
  • Your violation of any law or rights of third parties
15. Termination

Termination by You:

  • You may terminate your account at any time through account settings
  • No refunds for unused sessions or prepaid services (unless otherwise specified)
  • Your data will be deleted per our Privacy Policy (within 90 days)

Termination by Us:

We may suspend or terminate your access to the Service immediately, without notice, if:

  • You violate these Terms
  • You engage in abusive, threatening, or disruptive behavior
  • You fail to pay for services
  • We are required to do so by law
  • We discontinue the Service

Effect of Termination:

  • Your right to use the Service immediately ceases
  • We may delete your account and data per our Privacy Policy
  • Sections of these Terms that should survive termination (liability, indemnification, etc.) will continue to apply
16. Dispute Resolution & Governing Law

Governing Law:

  • These Terms are governed by the laws of the State of Massachusetts, United States, without regard to conflict of law principles
  • Any disputes shall be resolved in the courts of Massachusetts

Informal Resolution:

  • Before filing any legal claim, you agree to first contact us to seek informal resolution
  • We will attempt to resolve disputes in good faith within 30 days

Class Action Waiver:

  • You agree to bring claims against us only in your individual capacity, not as part of any class or representative action
  • You waive any right to participate in a class action lawsuit against Trackable Life
17. Changes to These Terms

We reserve the right to modify these Terms at any time. When we do:

  • We will post the updated Terms with a new effective date
  • For material changes, we will notify you via email at least 30 days before the changes take effect
  • You may be required to review and accept updated Terms before continuing to use the Service
  • Continued use after changes take effect constitutes acceptance of the new Terms
  • If you do not agree to updated Terms, you may terminate your account

  • Version 1 - January 23, 2026 - Initial version combining Terms of Service with comprehensive coaching agreement, liability waivers, ICF Code of Ethics alignment, detailed cancellation policies, coaching packages with platform access model, and subscription terms
18. Miscellaneous

Entire Agreement:

These Terms, together with our Privacy Policy and any other agreements you sign, constitute the entire agreement between you and Trackable Life.

Severability:

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

No Waiver:

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

Assignment:

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.

Force Majeure:

We shall not be liable for any failure to perform our obligations due to circumstances beyond our reasonable control (natural disasters, war, pandemics, internet outages, etc.).

Trackable Life is built and managed in-house, and we maintain our own application infrastructure. However, we partner with trusted third-party service providers for specific aspects of our service delivery. This page provides transparency about the processors and sub-processors we use to handle your data.

What Are Processors?

Processors are third-party companies that process data on our behalf to help us deliver Trackable Life services to you. For example, our email service provider processes your email address to send you login tokens and appointment reminders.

Sub-processors are third-party companies that may process data you store within Trackable Life as part of our service (such as your coaching session notes, trackable events, and personal information).

All processors and sub-processors listed below have signed Data Processing Agreements (DPAs) or have published terms that contractually obligate them to protect your data. By accepting our Terms of Service, you also acknowledge these third-party processors and their respective terms and conditions.

Our Commitment

What they process:

  • Audio and video streams during live coaching sessions (Google Meet)
  • Meeting information (date, time, duration, participant names)
  • Email communications (support inquiries, appointment confirmations)
  • IP addresses, device information, and connection metadata
  • Internal business documents (not client data stored in Trackable Life)

Data location: Global data centers (Google Cloud infrastructure)

Recording Policy:

We do not record coaching sessions. Recording features are disabled for all coaching meetings.

Note: Your Trackable Life application data (session notes, trackable events, personal information) is NOT stored in Google Workspace. Only support emails you send to us and meeting metadata may be stored in Google Workspace.
